The German court has sentenced a German agency for posting pictures without permission. The agency has published the photographic reproduction of a work by the artistic couple Christo and Jeanne-Claude. Made in 1995, the work no longer exists today and it consisted of the Reichstag’s packaging. The only traces have a photographic nature and they are posing some problems of copyright.
In this case, the German court found the image of the wrapped Reichstag as the reproduction of the work by Christo and therefore is not royalty free. The artist should get damages which amount is equal to his shortfall. The case’s losing agency believes the damage to be just under a thousand Euros.
